The client reported to an AssuredPartners Senior Living Claims Representative, that they had experienced an allegation of employee sexual assault of a female resident. The AssuredPartners Senior Living Claims Representative immediately engaged one of our Registered Nurses to consult with the facility Director of Nursing to discuss immediate action steps to mitigate any forthcoming regulatory findings.


The Registered Nurse provided telephonic consultation to the client and communicated they should anticipate an on-site complaint survey related to this self-reported incident that would likely result in an immediate jeopardy (IJ) citation. Consultative services were provided focusing on an IJ Abatement Plan and guidance related to the additional action steps (i.e. visual observation of staff member until building exit, resident and staff interviews, immediate staff education) that would be necessary to abate the immediate jeopardy situation prior to the arrival of the State Agency.


As expected, the client underwent a complaint survey within 14 days of self-reporting the incident to the State Agency. Although the client received an immediate jeopardy citation the incident was cited a past non-compliance citation due to the client’s commitment to implement recommended action steps. This assisted the client in minimizing the civil monetary impact by limiting the number of days the Immediate Jeopardy was in effect as well as avoiding an extended visit by surveyors.
